Use of any Albatrozz software product (including Golf & Membership, Hotel, F&B, Marina, CRM, Finance, Polo, Spa, AI Concierge, and all mobile applications) is governed by a separate Software Licence Agreement entered into between Albatrozz and the client organisation. These Terms of Use are supplementary to and do not replace any such agreement.

Where no separate agreement is in place, any access to or use of Albatrozz software products is strictly prohibited unless expressly authorised in writing by Albatrozz.

Where you are provided with, or you choose, a username, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

Albatrozz processes personal data in accordance with its Privacy Policy and the Malaysian Personal Data Protection Act 2010 (PDPA). By using the Platform, you consent to such processing. Our Privacy Policy is incorporated into and forms part of these Terms of Use.

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Malaysia.

You irrevocably agree that the courts of Malaysia shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or their subject matter or formation, without giving effect to any choice of law or conflict of law rules.

No waiver by Albatrozz of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Albatrozz to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

These Terms constitute the entire agreement between you and Albatrozz with respect to the Platform and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Platform.

Where you are a licensed Albatrozz software client, these Terms are supplementary to your Software Licence Agreement, which shall take precedence in the event of any conflict.
